These Terms (“Terms” or “Agreement”) relate to your use of the website www.omgimgettingmarried.com (“the Site” or “OMGImGettingMarried”). Please read them carefully before using the website – if you do not agree to be bound by these Terms, you may not use or access our services. These Terms may be modified or revised at any time, and any such modifications or revisions will become effective when we post an updated version of these Terms on the Site so please review them periodically. By using the Site in any manner, including but not limited to visiting or browsing the Site, you (the “user” or “you”) agree to be bound by this Agreement. This Agreement applies to all users of the Site, including without limitation users who are buyers, sellers, businesses, advertisers, contributors of content, information and other materials or services on the Site. OMGImGettingMarried as a Venue

OMGImGettingMarried acts as a venue offering sellers and members of the public and other interested parties the facility for users who comply with these terms to buy and sell wedding related items items and share information.

OMGImGettingMarried allows users to contact each other but is not a seller or distributor and never possesses the items offered through the site, does not transfer legal ownership of items from the seller to the buyer, and is not involved in the transaction between buyers and sellers.

The service is dependent upon the accuracy of the information provided by users of the site and accordingly OMGImGettingMarried is unable to accept any liability for loss or harm to you or any other person arising directly or indirectly from any incompleteness or inaccuracy of information provided by you or any third parties or any changes of circumstances that are not notified to us or which OMGImGettingMarried is not authorised to publish. OMGImGettingMarried does not give any warranty or other assurance that the Site meets any particular specification or requirements that you or any third party may have.

OMGImGettingMarried does not pre-screen users or review listings and has no control over the truth or accuracy of the listings, the ability of sellers to sell items or the ability of buyers to pay for items. Sellers sell and buyers buy at their own Risk.

OMGImGettingMarried cannot guarantee the true identity, age, and nationality of a user.

You agree that OMGImGettingMarried is a listing venue and as such is not responsible or liable for any content, for example, data, text, information, usernames, graphics, images, photographs, profiles, audio, video, items, and links posted by you, other users, or outside parties on OMGImGettingMarried . You use the OMGImGettingMarried service at your own risk.

Listing and Selling

Listing Description

By listing an item on the Site you warrant that you and all aspects of the item comply with OMGImGettingMarried’s Terms. You also warrant that you may legally sell the item. You must accurately describe your item and all terms of sale. Your listings may only include text descriptions, graphics, pictures and other content relevant to the sale of that item. All items must be listed in an appropriate category. Each listing must accurately and completely describe the item/items for sale in that listing. Each unique item must have its own listing

It is your responsibility to ensure your listing works, and enquiries are received correctly. Certain ISPs, anti-spam software or a combination of the two, can identify enquiries as spam and inadvertently block them and we accept no responsibility for such occurences.

All listings are published on the Site for a period determined by the seller and up to 12months. After this period, unless renewed, your listing(s) will expire and will no longer appear on the Site. You will be informed of this expiry by email, along with instructions on how to renew your listing or re-list. Failure to re-list your item following (30) days of the expiry will result in your listing information being deleted from the Site.

We reserve the right at our sole discretion, without prior notice and without liability to you, to refuse or delete content that we believe is inappropriate or in breach of these Terms. We also reserve the right at our discretion to restrict a user’s usage of the Site either temporarily or permanently, or refuse a user’s registration.

Prohibited Items and Activities

You are solely responsible for your conduct and activities on and regarding to OMGImGettingMarried and any and all data, text, information, usernames, graphics, images, photographs, profiles, audio, video, items, and links (together, “Content”) that you submit, post, and display on OMGImGettingMarried.

Your Content and your use of OMGImGettingMarried shall not:

  • Be false, inaccurate or misleading
  • Be fraudulent or involve the sale of illegal, counterfeit or stolen items
  • Be unrelated to weddings
  • Suggest or encourage any illegal activity
  • Infringe upon any third-party’s copyright, patent, trademark, trade secret or other proprietary or intellectual property rights or rights of publicity or privacy
  • Violate this Agreement or be in breach of any applicable laws or regulations
  • Be defamatory, libelous, unlawfully threatening, unlawfully harassing, impersonate or intimidate any person (including or other users), or falsely state or otherwise misrepresent your affiliation with any person, through for example, the use of similar email address, nicknames, or creation of false account(s) or any other method or device
  • Be obscene or offensive or contain pornography or be discriminatory (including in relation to sex, race, age, religion, or sexual orientation)
  • Contain any computer viruses, macro viruses, trojan horses, worms, or contain/transmit any code of a destructive nature that may damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information
  • Use any robot, spider or other automated device or manual process to collect email addresses or other personal information
  • Modify, adapt or hack OMGImGettingMarried or modify another website so as to falsely imply that it is associated with OMGImGettingMarried
  • Appear to create liability for OMGImGettingMarried or cause OMGImGettingMarried to lose (in whole or in part) the services of OMGImGettingMarried’s ISPs or other suppliers
  • Link directly or indirectly, reference or contain descriptions of goods or services that are prohibited under these Terms or you do not have the right to link to or include
  • Be in any way related to spamming or flooding
  • involve the transmission of any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (SPAM)
  • involve the transmission of any advertising or promotional material of any form which promotes services or websites which compete with OMGImGettingMarried or damage the reputation of OMGImGettingMarried
  • Impose an unreasonable load on our infrastructure or interfere with the proper working of OMGImGettingMarried
  • Cause our website to be interrupted, damaged, rendered less efficient or such that the effectiveness or functionality of our website is in any way impaired.

Fees and Services

OMGImGettingMarried is free for buyers and persons merely browsing the information available on it.

OMGImGettingMarried charges fees when users wish to sell products or advertise services on the Site. Changes to the fees charged for OMGImGettingMarried’s services are effective after OMGImGettingMarried publishes the changes on the Site. However, OMGImGettingMarried may choose to temporarily change the fees for OMGImGettingMarried’s services for promotional events – such changes are effective when OMGImGettingMarried posts the temporary promotional event on the Site. OMGImGettingMarried may, at OMGImGettingMarried’s sole discretion, change some or all of OMGImGettingMarried’s services at any time. In the event OMGImGettingMarried introduces a new service, the fees for that service are effective at the launch of the service. Fee changes will not affect listings posted prior to the publication of the change but will apply to renewals of expired postings after the date of publication of the change.

Payment of listing or advertising fees is due before your listing or advertisement will be accepted for publication on the Site. You are responsible for paying all fees associated with your use of OMGImGettingMarried. All payments are processed through PayPal and as such OMGImGettingMarried does not process any payments directly. Any VAT or other sales tax chargeable will be added to the amount of the fee notified to you before the payment request is submitted to PayPal.

Fees and Termination

If OMGImGettingMarried terminates a listing or your account, if you close your account, or if the payment of your OMGImGettingMarried fees cannot be completed for any reason, you remain obligated to pay OMGImGettingMarried for all unpaid fees.

Content License

OMGImGettingMarried does not claim ownership rights in your Content. You grant OMGImGettingMarried a license solely to enable OMGImGettingMarried to use any information or Content you supply OMGImGettingMarried with, so that OMGImGettingMarried is not violating any rights you might have in that Content. You grant OMGImGettingMarried a right to exercise the copyright, publicity, and database rights (but no other rights) you have in the Content, in any media now known or not currently known, with respect to your Content. You agree to allow OMGImGettingMarried to store or re-format your Content on OMGImGettingMarried and display your Content on OMGImGettingMarried in any way as OMGImGettingMarried chooses and you allow OMGImGettingMarried to display all or parts of your Content on other sites used by OMGImGettingMarried to promote listings such as, but not limited to, the OMGImGettingMarried Facebook page, Twitter account, Instagram account, or Pinterest account. OMGImGettingMarried will only use personal information in accordance with OMGImGettingMarried Privacy Policy.

As part of a transaction, you may obtain personal information, including email address and shipping information, from another OMGImGettingMarried user. Without obtaining prior permission from the other user, this personal information shall only be used for that transaction or for OMGImGettingMarried-related communications. OMGImGettingMarried has not granted you a license to use the information for unsolicited commercial messages. Without limiting the foregoing, without express consent from the user, you are not licensed to add any OMGImGettingMarried user to your email or physical mail list. You agree that you will treat as confidential all information received from another user of the Site that is not made publicly available by that user.

Re-Posting Content

By posting Content on OMGImGettingMarried, it is possible for an outside website or a third party to re-post that Content. You agree to hold OMGImGettingMarried harmless for any dispute concerning this use. You agree that you will not, without the relevant content owner’s permission, copy or republish or otherwise use in whole or in part another user’s content published on OMGImGettingMarried .

Information Control

OMGImGettingMarried does not pre-approve the Content provided by users that is made available on OMGImGettingMarried. If you find any Content to be offensive, harmful, inaccurate, or deceptive then please let OMGImGettingMarried know so that we can review the Content and consider if it should be removed.

There are also risks of dealing with underage persons or people acting under false pretense over which we have no control.

Additionally, there may also be risks of items being lost or damaged in transit or of buyers falsely claiming such occurrences.

By using OMGImGettingMarried, you agree to accept such risks and that OMGImGettingMarried is not responsible for any and all acts or omissions of users on OMGImGettingMarried. Please use caution, common sense, and practice safe buying and selling when using OMGImGettingMarried.

Other Resources

Where the Site contains links to other websites, OMGImGettingMarried has neither power nor control over any such website. OMGImGettingMarried is not responsible for the availability of outside websites or resources linked to or referenced on the Site. OMGImGettingMarried does not endorse and is not responsible or liable for any content, advertising, products, or other materials on or available from such websites or resources. You agree that OMGImGettingMarried shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such websites or resources.

Resolution of Disputes and Release

Should you have a dispute with one or more users, or an outside party, you release OMGImGettingMarried from any and all claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes. OMGImGettingMarried does not provide a mediation or dispute resolution service and any complaints must be dealt with directly between users.

Breach

Without limiting any other remedies, OMGImGettingMarried may, without notice, and without refunding any fees, delay or immediately remove Content, warn OMGImGettingMarried’s users of another user’s actions, issue a warning to a user, temporarily suspend a user, temporarily or indefinitely suspend a user’s account, terminate a user’s account, prohibit access to the Site, and take technical and legal steps to keep a user off the Site and refuse to provide services to a user if any of the following apply:

OMGImGettingMarried suspects (by information, investigation, conviction, settlement, insurance or escrow investigation, or otherwise) a user has breached this Agreement or Privacy Policy; OMGImGettingMarried is unable to verify or authenticate any of your personal information or Content; or OMGImGettingMarried believes that a user has engaged in improper or fraudulent activity in connection with OMGImGettingMarried or the actions may cause legal liability or financial loss to OMGImGettingMarried’s users or to OMGImGettingMarried .

Privacy

Except as provided in OMGImGettingMarried’s Privacy Policy OMGImGettingMarried will not sell or disclose your personal information (as defined in the Privacy Policy) to third parties without your explicit consent.

Liability Limit

In no event shall OMGImGettingMarried be liable for any damages whatsoever, whether direct, indirect, indirect, general, special, compensatory, consequential, and/or incidental, arising out of or relating to the conduct of you or anyone else in connection with the use of the Site or reliance placed on the use of it or the contents or information contained in it or any errors or omissions in either the material or the software, whether such errors or omissions result from our negligence or otherwise, OMGImGettingMarried’s services, or this agreement, including without limitation, loss of revenues, loss of profits, loss of contracts, loss of business, loss of data, any loss of goodwill or reputation, bodily injury(other than for death or personal injury arising from OMGImGettingMarried’s negligence), emotional distress, or any special, incidental or consequential damages.

In the event that OMGImGettingMarried is nonetheless liable to you, OMGImGettingMarried’s maximum aggregate liability to you shall not exceed the total of our fees charged to you during the year(s) in which the circumstances giving rise to the claim occured.

NO WARRANTY OF ANY KIND IS MADE IN RELATION TO THE CONDITION, SUITABILITY, AVAILABILITY, ACCURACY, RELIABILITY, MERCHANTABILITY AND/OR NON-INFRINGEMENT OF MATERIAL AVAILABLE FROM THIS WEBSITE, THE USER’S OWN EQUIPMENT, ANY OTHER SERVICE PROVIDER’S EQUIPMENT OR SERVICES, THE INTERNET, ANY PUBLIC LINES AND/OR OPERATOR NETWORKS.

Indemnity

You agree to indemnify and hold OMGImGettingMarried harmless from all claims, costs, demands and expenses, including reasonable legal fees and VAT, made by any third party due to or arising out of your breach of this agreement, or any material submitted by you, or the documents it incorporates by reference, or your violation of any law or the rights of a third party.

No Agency

You and OMGImGettingMarried are independent contractors, and no agency, partnership, joint venture, employee-employer or franchiser-franchisee relationship is intended or created by this Agreement.

OMGImGettingMarried Service

OMGImGettingMarried reserves the right to modify or terminate the OMGImGettingMarried service for any reason, without notice, at any time. OMGImGettingMarried reserves the right to alter these Terms or other Site policies at any time, so please review the policies frequently. If OMGImGettingMarried makes a material change OMGImGettingMarried will notify you by posting the changed Terms on the Site, or by sending you email notification of the change.

OMGImGettingMarried is not a telecommunications provider and connectivity to the Site is dependent upon third party service providers, including the billing/connectivity providers for your devices. Connectivity and service levels cannot therefore be guaranteed, but we will work with our own service providers in an effort to avoid or reduce interruptions to the Site. OMGImGettingMarried may also have to interrupt the service to carry out maintenance or in circumstances beyond our reasonable control, but we will endeavour to keep such interruptions to a minimum.
